Who Design Terms and Conditions set the rules for using whodesign.org. By using Who Design, you agree to the rules below, so please read every section carefully. Please note that these terms cover the use of our website, while additional terms may apply during newsletter subscription or sign-up, and separate terms apply if you decide to submit a design to us.
1. Your Acceptance of the Terms and Conditions
Who Design Terms and Conditions govern access to and use of Who Design, available at https://whodesign.org, and of all pages, features and content of whodesign.org. By accessing or using Who Design, you confirm that you have carefully read, understood and agreed to be bound by Who Design Terms and Conditions, the Who Design Privacy Policy and the Who Design Cookies Policy. Please continue to use Who Design only if you agree. The publisher of Who Design is identified in the Who Design Impressum.
2. Content Is for Entertainment and Information Only
Who Design publishes features about footwear and more. Everything published on Who Design, including articles, descriptions, images, rankings, daily features, quotes, links and advertisements, is provided for entertainment and general information purposes only. For professional, legal, financial, purchasing, investment or design advice, please consult a qualified and licensed professional, because content on Who Design is general information and carries no offer, endorsement, recommendation or guarantee of any product, service, person or company. Who Design is an independent editorial publication, so to purchase featured footwear designs, products or projects, please contact the respective designers or brands. You alone are responsible for any decision you take on the basis of content published on Who Design.
3. Provided As Is, Where Is and As Available
To the fullest extent permitted by applicable law, Who Design and all content published on whodesign.org are provided on an AS IS, WHERE IS and AS AVAILABLE basis, with all faults, and without warranties or representations of any kind, whether express, implied or statutory, including but not limited to any warranty of accuracy, completeness, timeliness, reliability, availability, merchantability, fitness for a particular purpose, title and non-infringement, and any warranty that whodesign.org will be uninterrupted, secure, error-free or free of viruses or other harmful components. Who Design does not warrant the accuracy, completeness or reliability of information supplied by designers, brands, advertisers or other third parties.
4. Limitation of Liability
To the fullest extent permitted by applicable law and regulations, Who Design, the publisher of Who Design and the owners, operators, editors, contributors, licensors, partners, sponsors, advertisers, affiliates and service providers of Who Design shall not be liable for any direct, indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, business, data, goodwill, reputation or opportunity, arising out of or in connection with the use of, or the inability to use, Who Design, or reliance on any content published on whodesign.org, even if previously advised of the possibility of such damages. Nothing in Who Design Terms and Conditions excludes or limits any liability that cannot be excluded or limited under applicable law.
5. Full Indemnity
You agree to fully indemnify, defend and hold harmless Who Design, the publisher of Who Design and the owners, operators, editors, contributors, licensors, partners, sponsors, advertisers, affiliates and service providers of Who Design from and against any and all claims, demands, actions, liabilities, damages, losses, judgments, settlements, costs and expenses, including reasonable legal fees, arising out of or related to (a) your use or misuse of Who Design, (b) your breach of Who Design Terms and Conditions, (c) your violation of any law or of any right of a third party, including intellectual property and privacy rights, and (d) any information you provide through Who Design or to the third-party services reached through Who Design. The obligation to indemnify survives any end, suspension or termination of your use of Who Design.
6. Intellectual Property
Featured works. The footwear designs, products, projects, photographs, renderings, descriptions, names, logos and trademarks featured on Who Design belong to the original creators, designers, brands and license holders of each work, who keep all rights to their intellectual properties and related rights. Each work is shown on Who Design for editorial or entertainment purposes, and the presentation of a work on Who Design leaves every right with the respective owners.
Original materials of Who Design. Except for third-party works, the original texts, the selection and arrangement of content and the layout of Who Design are protected by copyright and are © 2008 – 2026 Who Design. You are welcome to read Who Design and to share links to pages of whodesign.org for personal, non-commercial and lawful purposes. Please obtain prior and explicit written permission from the publisher of Who Design, and from the relevant rights holders for featured works, before copying, reproducing, scraping, harvesting, mirroring, framing, republishing, redistributing, selling or otherwise exploiting content of whodesign.org, except where the law expressly allows.
Notice to rights holders. If you are a creator or rights holder and believe that a feature on Who Design infringes an intellectual property right, or gives incorrect credit, you can send a written notice through the Who Design Contact page, indicating the address of the page, identifying the work and your rights in the work, and providing a way to reach you. Who Design reviews every notice promptly and, where appropriate, corrects or removes the content.
7. Third-Party Websites, Services and Advertising
Who Design contains links to, and content from, third parties, including the A' Design Award & Competition, Designers.org, the Design Encyclopedia and other partner and affiliated websites. Third-party websites are operated independently of Who Design, so their content, availability, terms and privacy practices remain the responsibility of the respective third party. You access third-party websites at your own risk and subject to the terms of the respective third party.
Advertising shown on Who Design is delivered by Massive Outreach Ads Network, the privacy-first advertising solution provider of Who Design. Advertisements are supplied by third parties, and each advertised product, service or advertiser remains solely the responsibility of the respective advertiser. Any dealings between you and an advertiser are solely and exclusively between you and that advertiser.
8. Forms and Forwarding to Third-Party Services
Some features of Who Design, such as the Who Design Submit Design page, the Who Design Newsletter page and the Who Design Encyclopedia page, work in two steps. You provide a few details on whodesign.org and may then be forwarded to a partner service that carries out the actual service. The partner service, and not Who Design, is responsible for processing your information and for everything that happens after the forwarding, under the terms and the privacy policy of that service. You also agree to provide accurate and truthful information and to enter only information that belongs to you or that you are authorized to share.
9. Acceptable Use
You agree to use Who Design for lawful purposes, to access whodesign.org through ordinary browsing and search engine indexing rather than through robots, crawlers, scrapers, bots or other automated means, to respect the security and availability of whodesign.org, its servers and its networks, to provide truthful information through the forms of Who Design, and to keep every credit, copyright and other notice intact.
10. Availability and Changes
The publisher of Who Design may change, suspend or discontinue Who Design, or any content or feature of Who Design, at any time, for any reason and without notice or liability. 11. Governing Law
Who Design Terms and Conditions, and any dispute arising out of or in connection with Who Design, are governed by the laws applicable in the jurisdiction of the publisher of Who Design identified in the Who Design Impressum, without regard to conflict of law rules and principles, and the competent courts of that jurisdiction have jurisdiction, unless mandatory consumer protection laws of your country of residence provide otherwise.
12. General Provisions
If any provision of Who Design Terms and Conditions is found invalid or unenforceable, the remaining provisions remain in full force and effect. A delay in enforcing any right or provision is not a waiver of that right or provision. Who Design Terms and Conditions, together with the Who Design Privacy Policy and the Who Design Cookies Policy, form the entire agreement regarding the use of Who Design.
